Notarial services
At our office we perform the full range of notarial services, offering assistance of the highest standard. Pursuant to Article 79 of the Act on the Notarial Profession, the Notary draws up, among others, notarial deeds whenever required by law or when the parties so wish. We prepare, for example:
- sale agreements for real estate / cooperative ownership rights to premises;
- preliminary sale agreements;
- gift agreements;
- developer agreements;
- agreements on the division of an estate;
- agreements on the dissolution of co-ownership;
- marital property agreements (prenuptial agreements);
- agreements on the division of joint marital property;
- establishment of land easements, personal easements and transmission easements;
- establishment of mortgages;
- life annuity agreements (umowa dożywocia);
- real estate exchange agreements;
- company agreements / statutes / founding deeds of companies;
- wills;
- deeds of voluntary submission to enforcement.
In addition, we draw up deeds of certification of succession, which have the force of a court declaration of acquisition of inheritance. Immediately after drawing up the deed of certification of succession, the Notary enters it in the Register of Deeds of Certification of Succession. As soon as it is registered, the deed of certification of succession has the effects of a final court decision declaring the acquisition of inheritance. Our notarial services also include:
- services concerning the European Certificate of Succession;
- services related to the succession administration of a natural person’s business;
- preparing certifications – the Notary certifies: the authenticity of a signature, the conformity of an official copy, extract or copy with the document presented, the date on which a document was presented, and the fact that a person is alive or present at a specific place;
- safekeeping of money, securities, documents and data on an electronic data carrier as referred to in the regulations on the computerisation of the activities of entities performing public tasks;
- preparing official copies, duplicates and extracts of documents;
- preparing drafts of deeds, declarations and other documents – at the request of the parties;
- filing applications for entries in land and mortgage registers.
We also perform other notarial services provided for in separate regulations.
Drawing up notarial minutes
We draw up minutes in the form of a notarial deed. In the cases provided for by law, the Notary records minutes of general meetings of social organisations, associations, cooperatives, companies and other legal persons. Furthermore, the Notary draws up minutes to record the course of certain acts and events producing legal effects — in particular the appearance of the parties and the declarations they make, as well as the non-appearance of the other party, at the request of the party appearing.
The notary is appointed to perform acts to which the parties are obliged, or wish, to give notarial form. Notarial acts performed by a notary have the character of an official document. The notary performs notarial acts at the notary office; an act may be performed outside the office if the nature of the act or special circumstances so require.
