The basic features of a notarial certification concern the authenticity of a signature – the notary confirms that the signature on a document was made by a specific person; this is particularly important for documents requiring identity confirmation or in situations where a signature must be certified for the document to have legal force.
In what situations are notarial certifications prepared?
In addition to notarial deeds, the notary also prepares certifications:
- certification of the conformity of a copy with the document presented – this may concern, for example, opinions or administrative decisions, court rulings, accounting documents, civil status records or certificates,
- certification of the authenticity of a signature – in some cases the form with a notarially certified signature is required by law; for example, under Article 31 of the Act on Land and Mortgage Registers and Mortgage, an entry in a land and mortgage register may be made on the basis of a document with a notarially certified signature, unless specific provisions require a different form of document; furthermore, under Article 180 of the Commercial Companies Code, the transfer of shares in a limited liability company should be made in written form with a notarially certified signature; and under Article 751 §1, the transfer or lease of a business or the establishment of usufruct should be made in written form with a notarially certified signature. These are just some of the cases in which the form with a signature certified by a notary is required,
- certification of the fact that a person is alive or present at a specific place – prepared, for example, when applying for benefits from ZUS (the Social Insurance Institution),
- certification of the date a document was presented – proof that the document existed at the time the act was performed.
Notarial certification of a signature
The process of certifying a signature by a notary at our office in Kraków involves several steps that ensure its correctness and effectiveness. First, the person who wants to have their signature certified must appear in person before the notary at the office. The notary verifies that person’s identity by means of a valid identity document, such as an ID card or passport. The person then signs the document in the notary’s presence.
